2. Nature of Platform & Limitation of Liability

Spot Hire acts strictly as an online marketplace and peer discovery tool linking clients/employers with independent day labor service providers. Spot Hire does not directly employ, manage, dispatch, transport, track, or control any user, nor does it supervise physical job sites or transit routes.

Comprehensive Liability & Safety Disclaimer: Spot Hire, its operators, directors, and affiliates are strictly not liable for any personal injury, fatality, abduction, kidnapping, assault, robbery, extortion, criminal acts by third parties, property damage, financial loss, transit/travel hazards, workplace accidents, substandard workmanship, or disputes arising from interactions, rendezvous points, travel arrangements, or services initiated/performed via our platform. All offline engagements and travel are undertaken strictly at the users' own risk.

Onboarding profile checks are administrative directory filters only and do not constitute an endorsement, background security clearance, or safety guarantee regarding any user's intent, mental health, or criminal background.

Users acknowledge that peer-to-peer local hiring carries inherent physical and environmental risks. In the event of any unlawful incident, missing person report, or emergency, Spot Hire will cooperate with official law enforcement investigations as required by law, without accepting operational, legal, or financial liability.

3. Platform & Subscription Fees / Refund Policy

Access to certain features, tier listings, or workforce matching capabilities on Spot Hire may incur applicable subscription or access fees (such as standard R100 tier billing where applicable).

Strictly Non-Refundable: All platform subscription, listing, and access fees paid to Spot Hire are strictly non-refundable under any circumstances, including account cancellation, lack of job matches/bookings, or business closure.
Subscription & Payment Enforcement: Platform privileges are active contingent upon timely payment. Accounts that fail to renew or miss payments will face immediate suspension until outstanding fees are settled.

4. Data Privacy & Information Protection

We respect your privacy and are committed to protecting your personal information in compliance with applicable data privacy regulations (including POPIA principles).

Information Collected: We collect personal details (such as names, contact numbers, email addresses, identification/verification data, and location details) strictly for account creation, search matching, and communication purposes.
Data Security: We implement robust administrative and technical safeguards to protect your data from unauthorized access. We do not sell or rent your personal information to third parties.

5. User Conduct & Account Security

Users are responsible for maintaining the confidentiality of their login credentials. Any fraudulent activity, provision of false identity/credentials, workplace safety violations, or misuse of the platform will result in immediate account termination and potential legal action.

Spot Hire reserves the right to modify or update these Terms and Conditions at any time without prior notice. Continued use of the website following any changes indicates your acceptance of the revised terms.
